The appeal court of Crimea has satisfied requests of Office of Public Prosecutor and has cancelled decisions which have legitimised cession of goods of Mishorsky park-reserve of nation-wide significance to private persons. The press-service of Office of Public Prosecutor of Crimea informs on it.

A greenhouse and a warehouse have been taken away from the tradors, but it ill not save the lost ancient park. Now from 23 hectares of Mishorsky park untouched there were only 9 hectares. Other territory is built up by cafe, cottages, trading tents and pavilions.

The appeal instance has agreed with arguments of supervising department which has indicated a number of defiances of the law by transfer to a private trader of a greenhouse (296,6 sq.m.) to park, recognised as void decisions sattlement council about property right registration, the certificate on it and the property contract of purchase.

The Office of Public Prosecutor has achieved the similar decision concerning storage room (73,9 sq.m.) in park territory, at-sight which was planned to build boarding house. The appeal court recognised all operations with park property void.

Also in Office of Public Prosecutor have underlined that agree with the law in a zone of object of is natural-reserved fund to protection all landscapes, landscape elements as such come under that have especial value, and the possible only limited building-reconstructive actions.

As it is known, the Mishorsky park is included into the earths Koreizsky sattlement council, but with the proviso that it is the earths of nature-reserved fund. However local authorities approve that have a just cause to dispose of park territory as its borders are not established, and all decisions on security obligations and state certificates on the earth are cancelled by vessels of various instance.

According to Government inspection of Crimea, present convocation settlement council has approved 11 decisions on allocation legal and to physical persons of the land lots in park territory. Now from 23 hectares of Mishorsky park untouched there were only 9 hectares. Other territory is built up by cafe, cottages, trading tents and pavilions.
